When you register with TradingMentors, we ask you to provide your full legal name and e-mail address. We may at times conduct surveys that ask you to provide demographic information such as gender, birth date and occupation. Why do we collect this Information? Only registered subscribers may access all of the services and features available on the Site. To become a subscriber, the only information TradingMentors needs is your full name and email address. We use Paypal (www.paypal.com) as our merchant vendor. If you do not have a Paypal account already you must complete their registration application online. You can only pay TradingMentors with a valid credit card (VISA, MasterCard, American Express or Discover). Paypal will ask you when you register to provide your credit card number and authorization to charge your credit card the monthly fee. They ask for personal information to enable them to authenticate your authorization with your credit card provider thereby protecting the security of all of our subscribers. We ask for your e-mail address because we update our subscribers via email about such things as site and technology changes or additions. In addition, from time to time we may send our subscribers, via e-mail, advertisements or promotional offers from other companies. How do we use your Information? We will store your personal information and use it to contact you when necessary. We reserve the right to disclose your personal information where required by law to regulatory, law enforcement or other government authorities. We may also disclose your information, if necessary, to credit reporting or collection agencies, or when disclosure is necessary to protect our rights or property. SUBSCRIPTION AGREEMENT Once you register with TradingMentors.com, you will be subject to this agreement and our Terms of Use. You also will be granting TradingMentors a limited license and other important rights to information you provide on our site, and will be authorizing us to provide certain information about you to third parties, such as mailing lists providers or promoters, and others in accordance with the TradingMentors Privacy Policy. Subscription Fee Paid Subscribers agree to pay a monthly subscription fee, and all subscribers agree to the Terms of Use of the TradingMentors site, which are set forth on the next page. They govern use of our site by registered subscribers and third parties. Once you authorize Paypal to charge your credit card the monthly fee on our behalf and you register with TradingMentors (registration constitutes your agreement to this Subscription Agreement and the Terms of Use), you may choose an on-line user name and password. This will permit you to enter the restricted portion of the site. Canceling Your Subscription If you wish to cancel your paid subscription with us, simply choose not to renew at the time of your expiration. You have full control over your subscription. However, monthly subscription fees which have been charged to your credit card in the past will not be refunded to you, in whole or in part. TradingMentors has the right to cancel your subscription and terminate this agreement if you fail to observe any provision of this Subscription Agreement or any of the Terms of Use of our site. We also can cancel your subscription if authorized charges to your credit card are not honored, or if TradingMentors is no longer authorized to charge your credit card. Upon cancellation, you will be denied further access to the restricted portion of the TradingMentors site. TradingMentors will have no obligation to return any portion of the subscription fees you have paid prior to cancellation. Your Obligations and Agreements If you become a subscriber of the TradingMentors website, you will be subject to all of the terms and conditions and the obligations of subscription set forth in this Subscription Agreement and our Terms and Conditions. You also will be granting us a limited license, certain rights and your consent to reproduce materials submitted by you, as described in our Release. In addition, information about you that you provide to us will be collected, stored, processed and transmitted in accordance with our Privacy Policy and may be sold or provided to third parties consistent with that policy, unless you notify us that you do not want us to sell or provide it to third parties. Duration of Our Agreement This Subscription Agreement and the Terms of Use, as well as your authorization to Paypal to charge your credit card for subscription fees on TradingMentors.com’s behalf (until cancellation), will continue for month to month as long as you are a subscriber. Evidence of Your Agreement with Us If you register with TradingMentors, provide Paypal with your credit card information, select a user name and password, visit and use our site, YOU WILL BECOME A PARTY TO AND BE BOUND BY ALL OF THE TERMS OF THIS SUBSCRIPTION AGREEMENT AND BE SUBJECT TO THE TERMS OF USE THAT FOLLOW, UNTIL AND UNLESS YOU CANCEL YOUR SUBSCRIPTION. Before you register, please let us know if you have any questions about your obligations. We also encourage you to download and retain copies of your Subscription Registration Form, this Subscription Agreement and the Terms of Use for your permanent records. TERMS OF SERVICE Applicability of Terms of Use for Subscribers FOR ANY INDIVIDUALS THAT HAVE REGISTERED AS A SUBSCRIBER WITH TradingMentors, THE FOLLOWING TERMS AND CONDITIONS WILL CONSTITUTE PART OF YOUR SUBSCRIPTION AGREEMENT WITH TradingMentors AND WILL GOVERN YOUR ACCESS TO AND USE OF INFORMATION AND SERVICES AVAILABLE AT TRADINGMENTORS.COM. Eligibility You warrant that you are at least 18 years of age. No person under the age of 18 may use this site TradingMentors' Right to Change Terms of Use TradingMentors has the right to change these Terms of Use and, except for any increase in our subscription fees, the terms of our Subscription Agreement for subscribers from time to time without any prior notice to you. However, we will post changes on the site and they will be effective as soon as they are posted. We encourage you to review periodically these terms to inform yourself of changes and any new or different terms. Changes to our subscription fee will be posted in advance and you will have 30 days to cancel your subscription before the changes become effective. You therefore acknowledge and agree that all investment decisions you may make, including decisions that take into account or rely on any information provided or made available by or from the TradingMentors site, are yours and yours alone and are made solely at your own risk. You also agree to bear complete responsibility for your investment research and decisions and acknowledge that TradingMentors has not and will not make any specific recommendations to you or any of its subscribers upon which you or any of them is entitled to rely. Ownership of the Site and All Materials You acknowledge and agree that all original works, content, logos, slogan, names or other marks, data, information and materials provided on or made available on or through the site ("Site Content") are proprietary to and belong to TradingMentors, unless otherwise specifically noted that is or may be subject to protection by copyrights, trademarks and service marks, intellectual property, or other proprietary rights and laws. Further, other subscribers and third parties may also provide content, materials, data and information to the site that is included in references to Site Content herein. There are opportunities for you to provide information, data or materials to the site including in the Live Classroom and Training Room. If you provide or post such information, data or materials, other than the specific subscriber information required for registering as a subscriber, to the site or in the Rooms, by voice, electronic means including e-mail, or otherwise ("Subscriber Provided Content"), we will treat it as non-confidential and non-proprietary to you. Except as expressly authorized by TradingMentors in writing, you agree not to sell, license, rent, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or modify any of our materials or create any derivative works from such materials or Site Content.
